Information for users on processing of their personal data

Samo S.p.A., Data Controller of the processing of personal data performed through the use of cookies and similar technologies by the www.samo.it website, hereby issues the following information pursuant to Art. 13 of Regulation (EU) 2016/679:

DATA COLLECTED FOR SENDING OF CURRICULA VITAE/RESUMES (“Work with Samo”)

We hereby inform you that users must enter their first and last name, area of interest, and an e-mail address in order to be selected and evaluated for a potential employment or a professional collaboration relationship with the Data Controller in compliance with the current legislative provisions, also by sending their Curriculum Vitae/Resume. Providing said data is optional, however, failure to provide the data or providing incorrect data will not allow for users to be contacted. 

Processing of data will take place through manual, computerized, telematics tools with methods strictly connected to the inherent purposes. The data will be communicated to the following parties or categories of parties: Group companies. The data will not be disseminated and will be processed for a period of six (6) months, after which, unless expressly reconfirmed by the party concerned, said data will be destroyed. Furthermore, it is noted that the above-stated data (in particular data pertaining to required personal data and professional experience) may be subject to verification. Your data may be disclosed to the Data Processor and the following categories of parties in charge of processing: personnel in the department involved in the selection process. In evaluating the above-stated information in order to provide your consent to the processing of personal data, please keep in mind that some data defined as “special categories of personal data” (pursuant to Art. 9 of Regulation (EU) 2016/679) (relating in particular, to certain protected categories), may also be contained in the personal data subject to your consent. We hereby inform you that users must enter their first and last name, address, e-mail, and the purpose of their requests to the Data Controller. Providing said data is optional, however, failure to provide the data or providing incorrect data will not allow users to receive accurate information in reply to their requests. Processing of data will take place through manual, computerized, and/or telematics tools; the data will not be communicated or disseminated to third parties, and will be kept in special databases owned by the Data Controller only for the time necessary to ensure accurate data to reply to your information requests. We hereby inform you that users must enter their first and last name, address, and e-mail, for the periodic sending of a newsletter. Providing said data is optional, however, failure to provide the data or providing incorrect data will not allow users to receive the requested newsletter. Processing of data will take place through manual, computerized, and/or telematics tools; the data will not be communicated or disseminated to third parties, and will be kept in special databases owned by the Data Controller until the user communicates their intent to cancel sending of the newsletter. Processing of data will take place though manual, computerized, and/or telematics tools; the data will not be communicated or disseminated to third parties, and will be kept in special databases owned by the Data Controller until the user communicates their intent to cancel sending of the newsletter. DATA COLLECTED TO ACCESS THE RESERVED AREA (“Price List” – Home - professionals)

We hereby inform you that users must enter their first and last name, customer code, and e-mail, to access the reserved area and view the product price list. Providing said data is optional, however, failure to provide the data or providing incorrect data will not allow users to view the product price list. Processing of data will take place though manual, computerized, and/or telematics tools; the data will not be communicated or disseminated to third parties, and will be kept in special databases owned by the Data Controller until the user communicates their intent to cancel access to the reserved area. DATA COLLECTED TO BECOME A RETAILER (“Become a SAMO retailer” – Home - professionals)

We hereby inform you that users must enter their first and last name, and e-mail, in order to be contacted to establish a potential business relationship with the Data Controller as a local retailer. Providing said data is optional, however, failure to provide the data or providing incorrect data will not allow users to be contacted. Processing of data will take place though manual, computerized, and/or telematics tools; the data will not be communicated or disseminated to third parties, and will be kept in special databases owned by the Data Controller, even if said affiliation should not come to fruition, for a maximum period consistent with the Data Controller’s need to expand retail coverage, and nevertheless, not greater than one (1) year, after which, unless expressly reconfirmed by the party concerned, said data will be destroyed. DATA COLLECTED TO REQUEST ASSISTANCE (“Request assistance”)

We hereby inform you that users must enter their first and last name, address, phone, e-mail, and the reasons for requesting assistance in order to be contacted based on their request, also by sending the proof of purchase as well as visual and technical evidence proving the damage. Providing said data is optional, however, failure to provide the data or providing incorrect data will not allow users to be contacted.  Processing of data will take place though manual, computerized, and/or telematics tools; the parts/components subject to the request will be communicated to the retailer where they were purchased, the data will not be disseminated and will be kept in special databases owned by the Data Controller only the time necessary to ensure resolving of the user’s issues. BROWSING DATA

During normal operation, the computer systems and software procedures required to operate this website, collect some personal data that is implicitly transmitted during the use of internet communication protocols. This concerns data related to telematics traffic, which by its nature, cannot be readily linked to the user. However, processing or association with data held by third parties may allow the user to be identified (e.g. IP address, or computer domain name used by the user for connecting to the website, or other parameters related to the user’s operating system and the IT environment, etc.).

Such data is used only for anonymous statistics related to the use of the website, or to verify its correct operation. The data may be used to ascertain liability in case of potential cyber crimes damaging the website, since it constitutes full, incontrovertible factual evidence and proof of the actions performed by the user before the Data Controller and/or Third Parties.

Said data is strictly confidential and may be shown and/or provided solely upon the request of Parties expressly indicated by Law. The Data Controller will adopt all the technical and organizational measures necessary to ensure said confidentiality. The data is only kept by the Data Controller for the period strictly necessary and in compliance with the pertaining current legislative provisions. After said period, the data will be destroyed and the possibility of obtaining a copy will not longer be ensured.

 

 

COOKIES

Cookies are small text files that are sent from the computer on which the website is running, are saved in the user’s device during navigation, and perform various functions such as remembering the selected language data, collecting statistics data on the pages visited, identifying the browser and the device used, selecting targeted content and communications based on preferences, and more. The cookies are then forwarded to the computer running the website during subsequent visits. This site uses cookies that allow for saving and transporting information. The cookies are used by both the Data Controller and by Third Parties.

Cookies may be of various types, depending on the type of data saved and how long it remains saved on the user’s device.

The cookies used on this website are “technical” cookies, namely:

  • “Browsing or Session” cookies that ensure normal navigation and use of the website (allowing, for example, to authenticate access to a reserved area), avoid the need for other technologies that could compromise the confidentiality of the user’s navigation on the website, and do not allow for collecting the user’s personal identification data;
  • “Analytical” cookies that allow the Data Controller and Third Parties to collect aggregate data on the number of users and on how the latter visit said website;
  • “Functionality” cookies that allow the user to navigate based on a series of selected criteria (for example, language) in order to improve the service provided by the website.

The website uses “technical” aggregate cookies to ensure and facilitate navigation and use of the services, and to collect aggregate data on website visits.

No “profiling” cookies are used on the website, or namely cookies aimed at creating user profiles and subsequently used to send advertising messages in line with preferences shown by the latter while surfing the internet. 

The user’s consent is not required for installing “technical” cookies. The user may, however, always disable cookies by modifying browser settings; such disabling of cookies may however, slow down or prevent access to some areas of the website.

SOCIAL NETWORKS

The website contains so-called social buttons, namely those “buttons” showing social network icons (Facebook, YouTube, and Pinterest) that allow browsing users to interact directly with social platforms with just one “click”.

The social buttons used by the site are links that redirect to the Data Controller’s accounts on the social networks depicted. The use of such buttons, therefore, does not allow cookies to be installed by Third Parties.

Similarly, the website contains links redirecting users to other websites, some even through advertising images that do not belong to, or that are not directly supervised by, the website operator, and some of which use Third Party cookies.

COMMUNICATIONS

Notwithstanding communications made for the fulfillment of legal and contractual obligations, for upholding of legal rights and upon request by the competent Authorities, as well as for the above-stated purposes, the data may be communicated to: 

  • Employees and/or contractors of the Data Controller to whom it is necessary to transfer such data, or when it is aimed at carrying out the activity requested by the user; 
  • Professionals and/or Offices and/or Companies for administration and management that may work on behalf of the Data Controller; 

  • Professionals and/or Offices and/or Companies for installation, maintenance, updating and, in general, management of hardware and software owned by the Data Controller, or used by the latter to provide web services.

The recipients of communications are in any case, appropriately appointed as Data Supervisors and/or Processors by the Data Controller.  

User data will not be subject to any dissemination (namely, any communication to an unknown number of other parties).

 

 

USER RIGHTS

Users may exercise a series of rights.

In the first place, you may contact the Data Controller to obtain information about the origin and purpose of the processing of their personal data, the categories of data processed, which recipients or categories of recipients their data was communicated, or will be communicated, the period of data storage, or if not possible, the criteria used for its determination.

For personal data provided, you have the right to obtain correction of incorrect data and supplementation of incomplete data. Moreover, you have the right to request deletion of said data, unless attributable to legal and contractual obligations, and subject to processing in certain circumstances. 

You have the right to receive your personal data from the Data Controller and to forward said data to another Data Controller without any impediment.

Furthermore, you have the right to revoke consent for each of the purposes granted, at any time. 

You have the right to lodge a complaint with the supervisory authority.

UPDATES

The Data Controller for personal data reserves the right to periodically update this privacy policy without advance notice, ensuring in any case, an adequate and similar protection of personal data. In said case, any updates will be effective immediately upon publication on the website. In order to view any updates, users are urged to regularly consult this privacy policy, which in any case, specifies the date of the last update as 07/25/2018.

 

 

CONSENT

The issuing of consent to the processing of personal data by the Data Controller, as indicated and specified above, is not necessary pursuant to Art. 6, Paragraph 1, Letter b) and Art. 9, Paragraph 2, Letter b) and h) of Regulation (EU) 016/679, since it is exclusively linked to specific user requests or to labor law obligations and employability evaluations.
